CITY OF LIVONIA ORDINANCE NO. ___
AN ORDINANCE TO AMEND TITLE ___ OF THE LIVONIA CODE OF
ORDINANCES TO ESTABLISH A STREAMLINED PROCEDURE FOR
APPROVAL OF BLOCK PARTY PERMITS.
THE CITY OF LIVONIA ORDAINS:
Section 1. Title ___, Chapter ___ of the Livonia Code of Ordinances is hereby
amended to add the following Section:
Sec. __-__. Block Party Permits.
(1) Permit Required.
No person shall close or cause to be closed any public street, or portion thereof,
for the purpose of conducting a neighborhood block party without first obtaining
a Block Party Permit pursuant to this Section.
(2) Application.
(a) Application for a Block Party Permit shall be made to the City Clerk or such
other office as designated by the Mayor or City Council;
(b) The application shall be filed not less than fourteen (14) days prior to the date
of the proposed event and shall include:
1. The name, address, and contact information of the applicant;
2. The location and description of the street or streets to be closed;
3. The date and hours of the proposed block party;
4. An estimate of the number of participants;
5. Any additional information required by administrative regulation.
(3) Administrative Approval.
(a) Upon receipt of a complete application, the City Clerk, in consultation with
the Police Department, Fire Department, and Department of Public Works, shall
issue a Block Party Permit provided that the proposed event does not present a
threat to public health, safety, or welfare;
(b) Issuance of a Block Party Permit under this Section shall be deemed a
ministerial act and shall not require formal action by the City Council, except as
provided in subsection (4).
(4) Exceptions Requiring Council Approval.
(a) Any request for a waiver of the City’s noise ordinance, extension of hours
beyond those otherwise permitted, or deviation from other applicable ordinances
shall require approval by resolution of the City Council.
(b) Nothing herein shall preclude an applicant from voluntarily requesting
consideration of a Block Party Permit by the City Council.
(5) Conditions of Permit.
(a) All permits issued pursuant to this Section shall be subject to conditions
imposed by the City to ensure public safety, including but not limited to:
1. Maintenance of emergency vehicle access at all times;
2. Provision of adequate traffic control and barricades;
3. Compliance with all applicable state laws and City ordinances.
(b) Failure to comply with the conditions of the permit shall constitute grounds
for immediate revocation and may subject the violator to penalties under this
Code.
Section 2. Repealer.
All ordinances or parts of ordinances in conflict herewith are, to the extent of
such conflict, hereby repealed.
Section 3. Severability.
If any section, subsection, sentence, clause, phrase, or portion of this ordinance is
for any reason held invalid or unconstitutional, such portion shall be deemed a
separate, distinct, and independent provision, and such holding shall not affect
the validity of the remaining portions.
Section 4. Effective Date.
This ordinance shall take effect upon publication in a newspaper of general
circulation in the City of Livonia, as required by law.
